Terms of Service

Effective Date: March 15, 2026

By creating an account, provisioning a database, or otherwise using MVP-DB, you agree to be bound by these Terms of Service.

1. The Service

MVP-DB provides "Schema-level Virtual Databases" (vDBs). Each vDB is a managed logical partition within our shared infrastructure. We design the Service to provide logical isolation between tenants, while resource usage is managed across shared infrastructure.

2. Payments & Billing

Payments, subscriptions, taxes, refunds, and chargebacks are processed by Lemon Squeezy, our Merchant of Record. When you purchase a subscription, the transaction is between you and Lemon Squeezy, subject to Lemon Squeezy's applicable terms and policies.

Subscriptions renew automatically at the end of each billing period unless cancelled before renewal. You may cancel your subscription from your dashboard or through the billing management flow provided by Lemon Squeezy.

No refunds for partial billing periods. When you subscribe, you purchase access for the full billing period. Cancelling mid-period stops the next renewal but does not entitle you to a pro-rated refund for unused days. Your database remains active until the current paid period ends, unless suspended for abuse or violation of these Terms.

Prices, taxes, and fees are displayed at checkout by Lemon Squeezy. Any applicable sales tax, VAT, GST, or similar charges are calculated and handled by Lemon Squeezy as Merchant of Record.

3. Data Safety & Security

• Encryption: All data is encrypted at rest and in transit (SSL/TLS).
• Backups: We perform automated daily backups with plan-based retention for disaster recovery: 7 days on Starter and Builder, and 30 days on Pro.
• Responsibility: While we target 99.9% infrastructure uptime, users are responsible for their own application-level data integrity. Customers are responsible for maintaining independent backups of critical data.

While we strive to maintain high availability, the Service may experience interruptions due to maintenance, upgrades, or unforeseen technical issues. MVP-DB does not guarantee uninterrupted availability and shall not be liable for any losses resulting from temporary service interruptions.

4. GDPR & Privacy

We comply with GDPR requirements. As a service provider, MVP-DB acts as the Data Processor. You (the user) are the Data Controller. You retain full ownership of all data stored in your databases. We store only the minimum data required for billing and service performance. Data is hosted on AWS infrastructure in secure regions.

5. Acceptable Use

You agree not to use MVP-DB for any illegal activities, crypto-mining, or activities that excessively consume shared infrastructure resources or degrade the performance of other users ("Noisy Neighbor" behavior). We reserve the right to throttle, limit, or suspend workloads that negatively impact the stability or performance of the shared infrastructure.

Users are solely responsible for the content and data stored in their databases. MVP-DB does not monitor database contents and assumes no responsibility for user-generated data. We may remove or suspend access to data that violates applicable laws or these Terms.

6. Termination

Upon cancellation or termination of your account, your virtual database schemas and associated data will be queued for deletion. Deleted data is removed from active systems within 48 hours and may remain in encrypted backups for up to 30 days before permanent deletion.

7. Limitation of Liability

To the maximum extent permitted by law, MVP-DB and its operators shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, loss of data, or business interruption.

Our total liability for any claim relating to the Service shall not exceed the total amount paid by you to MVP-DB during the preceding 12 months, or $100 USD, whichever is lower.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available". MVP-DB makes no warranties, express or implied, regarding availability, reliability, or fitness for a particular purpose.

9. Governing Law

These Terms are governed by the laws of Bosnia and Herzegovina (Republika Srpska). Any disputes shall be resolved by the competent courts located in Trebinje.

10. Changes to the Service

MVP-DB may modify, suspend, or discontinue parts of the Service at any time to maintain performance, security, or stability.
